  Term of Office:  Commencing January, 2007, the term became a 4 year term.  Election is always in the Fall.

The Clerk of Court is responsible for managing the administrative activities of the Clerk's office and overseeing the performance of the statutory duties of the office.  Those duties include the filing and case management of all proceedings handled through the justice system.  The Clerk additionally collects various fees, fines and forfeitures as ordered by the court or specified by statute.  Jury management and the issuance of passports is also handled in the Clerk of Court office.

Duties are discussed and evaluated in order to determine the best and most efficient procedure to follow, in order to produce greater productivity with an end result of more revenue to the county.  It is the goal of the office to abide by the ever-changing statutes that govern our daily duties in order to provide efficiency to the Judiciary.

Upon filing your paper work, please have the original and four copies w/you to be stamped and returned.  If you are JT Petitioners, three copies are sufficient.  At the time of filing, you will be given a date for an Order for Appearance for a Scheduling Conference.  Please read this page carefully.  The date is basically set out to accomodate the 120 day waiting period requirement.  Should all issues be settled, you may call the above number to obtain a hearing date for your final divorce.

Small Claims

Plaintiff:  Party commencing the action

Where to File:  The county in which the Defendant lives or where the transaction took place.

Filing Fee:  Commencing the action § 814.62(3)(a) - $94.50 plus $2.00 mail fee (per Defendant) if the defendant lives within Calumet County.  If Defendant lives outside of the county, he/she needs to be personally served.  Said fee depends on the process server you hire.  Should judgment be granted to the Plaintiff, the above mentioned costs will be added by the Clerk.

Maximum Amount:  $5,000.00  It is not a mandatory appearance for the parties to appear for the original return date if the request is for a money judgment.  The Defendant has the option of filing the Statement of Defense, stating the issues that are contested, prior to the scheduled return date to avoid having to appear.  If the Defendant is in agreement with the facts stated in the complaint, there is no need to do anything but to contact the Plaintiff/Attorney to make payment agrangements, as a default judgment will be granted. Upon the filing of the Statement of Defense by the Defendant, a notice will be mailed to the parties indicating the date and time for a Pre-Trial Conference, at which time all parties need to appear.

Docket Fee:  $5.00 to have the judgment placed on the Lien Index.  Fee to be paid by Plaintiff.  Upon Judgment satisfied in full, a Satisfaction of Judgment should be filed by the Defendant for $5.00, to indicate to the abstractors that the lien has been satisfied.

Evictions:  Defendant must be personally served.  For the Court's convenience, we ask that the 5-day notice is attached to the Complaint at the time of the filing.  It is a mandatory appearance for all parties.  Should a Judgment of Eviction be granted, the Landlord has the option to file an Amended Complaint for rent and damages once they have regained possession of the premiss. 

Replevins:  Defendant must be personally served.  It is a mandatory appearance for all parties.

When applying for your passport at the Clerk of court Office, please allow sufficient time (at least 30 minutes) to file the application.  You may obtain the forms in advance at the Clerk of Court office or on line at the link indicated below.  Please bring along your photo ID, 2 passport pictures and your payment.  Any questions, please call 920-849-1415.
